Terms and Conditions for the Year13 & JMC Festival Fomo Competition 2020.

  1. The promoters of the Competition are Year 13 Pty Ltd (ABN 93 606 583 706) of G02 84 Alexander Street, Crows Nest NSW 2065 and JMC Pty Ltd (ABN 53 003 572 012) of 561 Harris Street, Ultimo NSW 2007 (the "Promoters").
  2. Entry into the Promotion is only open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):

a. Individuals must be an Australian resident;

b. Individuals must not be an employee (or a member of their immediate family (spouse, parent, sibling or child) of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter);

c. Individuals must be aged 17 years or older; and

d. Individuals under the age of 18 must have parent or guardian consent to participate in and win a prize in this Promotion. In addition, the parent/guardian of the individual must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion and winning a prize.

  1. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoters may in their discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. Any additional terms and conditions on the Promoters’ websites or announced on air or in print form part of these Terms and Conditions and where there is any inconsistency between these Terms and Conditions and additional terms and conditions relevant to a particular competition, the specific terms and competitions shall prevail.
  2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and place of study) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  3. Entry into the Competition is free.
  4. To enter, Eligible Entrants must answer all required questions on the Competition Page (https://year13.com.au/pages/jmc-festival-fomo-competition) and answer in 100-150 words "what your dream festival would look like?" "how you would organise it?" & "who would be your top 3 headliners?"Entries on the Competition Page must be received before 11:59PM AEST on 30th November 2020. Entries received after this time will not be eligible for the Competition.
  5. Competition commences 8th October 2020 and final entries to the Competition must be received by 11:59PM AEST on 30th November 2020 (“Competition Period”).
  6. There will be one (1) prize awarded in this Promotion.
  7. The prize includes:
  • A pair of AirPods Pro
  • Career mentoring session organised by JMC Academy

The mentoring session must be redeemed within three months of the Winner Notification Date (as defined below). The sessions can be completed over the phone or via video chat (e.g. Skype or Zoom). 

Mentoring sessions can be focused on a range of topics including, but not limited to: discussing what the young person wants to do in their career, industry information and how to get started, learning about the mentor's career path, and how JMC Academy can assist them in achieving their goals.

  1. Prizes are not transferable, exchangeable, or redeemable for cash.
     
  2. If a prize includes travel, The Winner (as defined below) and any travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure. Air tickets are for travel on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. Frequent Flyer points are not available from any airline in respect of flights awarded under this Promotion. A credit card imprint or cash deposit may be required from the Winner at check-in to the hotel, which may be used in relation to incidental charges (which are not included in the Prize). Once accommodation vouchers for accommodation awarded in this Promotion are issued they are non-changeable. It is the travellers’ personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers. Travel insurance does not form part of the Prize, it is the travellers’ personal responsibility to ensure they have valid travel insurance. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. Travel must be taken at the time specified by the Promoter and must coincide with the dates specified in these terms and conditions. If a Winner or any travelling companion is, for whatever reason, unable to travel on a nominated date, or do not take an element of the Prize within the time stipulated by the Promoter then that element of the Prize will be forfeited by the Winner. Cash will not be awarded in lieu of the Prize or any element thereof.
     
  3. As this Promotion is a Game of Skill; chance plays no part in determining the Winner.
     
  4. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.
     
  5. An entrant’s entry must not include:
    1. any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;
    2. any content that contravenes any law, infringes the rights of any person or is obscene, offensive, potentially defamatory, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
    3. any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Conditions of Entry.
       
  6. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.
     
  7. The winning entry will be determined to be the most original and creative while also demonstrating personality & skill. Entries will be judged by JMC Academy & Year13 and the Eligible Entrant that submitted the winning Entry will be declared the winner (Winner). The judges’ decision will be final and no correspondence will be entered into. The judges, in their sole discretion, may not allocate any Prize(s), or fewer than the number of Prize(s) stated above (including in circumstances where insufficient Entries are received or Entries are judged to be of a poor standard).
     
  8. In the event of similar or the same Entries being received from different Entrants, the Entry received first in time will be the only valid Entry.
     
  9. The Winner will be notified on 16th December 2020 (“Winner Notification Date”). The Promoters’ decision is final and no correspondence will be entered into. An entry is deemed to be received at the time of its receipt by the Promoters and not at the time of transmission by the entrant.
  10. Any entry received after the specified competition period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
  11. You may not enter the Competition more than once.
     
  12. No component of the prize can be transferred or redeemed for cash (excluding cash aspects of the prize). In the event that any of the prizes become unavailable due to circumstances beyond the Promoters’ control, the Promoters reserve the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
     
  13. You agree that the Promoters may use your entry and any personal details provided to the Promoters in accordance with Year 13’s Privacy Policy and JMC Academy's Privacy Policy and for any promotional, marketing and publicity purposes of the Promoters in any media without notice and without any fee being paid to you.
     
  14. Decisions of the Promoters are final and will be binding on each person who enters the Competition and no correspondence will be entered into.
     
  15. Any prize must be claimed within 30 days of the selection of the Winner. If the prize has not been claimed within 30 days, the winner relinquishes any right or interest in the prize. If a prize is unclaimed or a winner is not contactable, there will be no re-draw and the prize will be forfeited, unless otherwise notified by the Promoters.
     
  16. If there is any event that prevents or hinders the Promoters’ conduct of the Competition or the Promoters’ ability to deliver the prize to the prize Winner, the Promoters may, at their discretion, cancel the Competition and recommence it at another time under the same conditions or select another Winner.
     
  17. The Promoters are not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoters assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
     
  18. Each response submitted as part of an entry (“Response”) becomes the property of the Promoters. As a condition of entry, each entrant irrevocably grants to the Promoters a non-exclusive perpetual worldwide licence to use and exploit all intellectual property rights (including, without limitation, copyright) in and to the Response and consents to the Promoters doing (or omitting to do) any acts in respect of the Response which may otherwise constitute an infringement of an entrant’s moral rights. For the avoidance of doubt, the Promoters may use all or part of an entrant’s Response for promotional, marketing or publicity purposes, whether in respect of the competition, the Promoters or otherwise. Each entrant warrants to the Promoters that the Response submitted is an original work of the entrant which does not infringe any rights of any third party. A breach of the warranty set out in this condition will result in the entrant’s entry being invalid. In addition, each entrant indemnifies the Promoters against all loss, damages and costs incurred by the Promoters arising from that entrant’s breach of the warranty set out in this condition.
     
  19. To the full extent permitted by the law, Year 13 Pty Ltd will not be liable for any death, injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize.
