Terms and Conditions for the Year13 Aware Super Supercharge Your Future Competition 2021
General
- The promoter of the Competition is Year 13 Pty Ltd (ABN 93 606 583 706) of G02 84 Alexander Street, Crows Nest NSW 2065 (the "Promoter”).
- Entry into the Year13 Aware Super Supercharge Your Future Competition 2021 (the “Competition”) is only open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
- Individuals must be an Australian resident;
- Individuals must not be an employee (or a member of their immediate family (spouse, parent, sibling or child) of the Promoter or the Promoter’s related entities directly involved in the Competition (as determined by the Promoter);
- Individuals must be aged 15 years or older; and
- Individuals under the age of 18 must have parent or guardian consent to participate in and win a prize in this Promotion. In addition, the parent/guardian of the individual must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion and winning a prize.
- Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may at their discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. Any additional terms and conditions on the Promoters’ websites form part of these Terms and Conditions and where there is any inconsistency between these Terms and Conditions and additional terms and conditions relevant to a particular competition, the specific terms and conditions shall prevail.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and place of study) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
- Entry into the Competition is free.
Who can enter
- Entry is open to all Australian residents of 15 years of age or older and who fulfil the method of entry requirements.
- Directors, contractors and employees (and immediate families) of the Promoter and of companies, suppliers and agencies associated with the Promotion are not eligible to enter the Promotion.
- The Promoter reserves the right at its sole discretion to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. If a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
- Only one entry per person
- In order to receive any cash prizes, the name provided by the entrant in his or her entry must be the same as the name of an eligible bank account into which a cheque can be deposited. If a winning entry does not contain this information, then the Promoter may not be able to distribute the prize to the winner.
- Unless otherwise expressly stated, prize values are based on the recommended retail prices at the time of first publication of these terms and conditions (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
- Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
- Prizes cannot be transferred, exchanged or redeemed for cash.
- It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
- It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
Competition Period
- The Competition commences on 7 August 2021 and final entries to the Competition must be received by 11:59PM AEST on 7 January 2022 (“Competition Period”).
How to Enter
- To enter the Competition, Eligible Entrants must:
- Register to Year13 and complete the Super Aware Academy module here (https://year13.com.au/academy/aware-super) by 11:59PM AEST 31 December 2021 AEST. This includes providing a valid email, phone number, date of birth and post code to register with Year13; and
- Respond to the question sent via email to the Eligible Entrants nominated email address with a video response (maximum 2 minutes). The question to be addressed is “What did you learn from the completing the Aware Super Aware Module and How will you use the prize money to Supercharge your Future”
- The video file must be in either mp4, m4V or mov format and sent via email to socials@year13com.au email.
- Video entries (“Entry”) must be received by 11:59PM AEST by 7 January 2022. to be included in the Prize Judging. Entries received after this time will not be eligible for the Competition.
- An Entry is deemed to be received at the time of its receipt by the Promoter and not at the time of transmission by the entrant.
- As this Competition is a Game of Skill; chance plays no part in determining the Winner.
- Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the Entry is the entrant’s original work. If an Entry cannot be verified to the Promoter’s satisfaction, the Entry will be deemed invalid.
- An Entry must not include:
- any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;
- any content that contravenes any law, infringes the rights of any person or is obscene, offensive, potentially defamatory, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
- any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Conditions of Entry.
- The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s Entry.

- Prizes are not transferable. Prizes must be taken as offered. Prize values are in Australian dollars. Prize Winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
- Prize money will be transferred into the bank account nominated by the Winner/s. The Promoter will not be responsible for the Winner/s not receiving prize funds as a result of incorrect bank account number details or other details affecting the transfer.
- If the prize Winner/s is under 18 years of age at the time of judging, the prize/s will be awarded to their nominated Parent or Legal Guardian on behalf of the Winner/s. The Winner/s and parent or guardian may be required to sign a prize transfer form.
- The Winners are required to provide three (3) testimonials to the Promoter within a 12 month period from January 2022 to show how the Prize has been used to facilitate the Winners’ passion and purpose in achieving their goal as described in the Entry. The testimonials may be but are not limited to image, video or written form and the Winners will receive instructions from the Promoter from time to time in relation to the testimonials.
Prize Judging
- The winning entry will be determined to be the most original and creative while also demonstrating personality & skill. Entries submitted by Entrants will be judged by the Promoter. The winning Entry will be declared the Winner (the “Winner”). The judges’ decision will be final and no correspondence will be entered into.
- In the event of similar or the same Entries being received from different Entrants, the Entry received first in time will be the only valid Entry.
- The Winner will be notified on 30 January 2022 by the Entrant’s email and/or phone. The Promoter will also publicise the winner on its website, www.year13.com.au. The Promoter’s decision is final and no correspondence will be entered into.
Standard Terms
- Any entry received after the specified Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
- You may not enter the Competition more than once.
- No component of the Prize can be transferred. In the event that any of the prizes become unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
- You agree that the Promoter may use your Entry and any personal details provided to the Promoter in accordance with Year 13’s Privacy Policy and for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.
- Decisions of the Promoter are final and will be binding on each person who enters the Competition and no correspondence will be entered into.
- Any prize must be claimed within 30 days of the selection of the Winner. If the prize has not been claimed within 30 days, the Winner relinquishes any right or interest in the prize. If a prize is unclaimed or a winner is not contactable, there will be no redraw and the prize will be forfeited, unless otherwise notified by the Promoter.
- If there is any event that prevents or hinders the Promoter’s conduct of the Competition or the Promoter’s ability to deliver the prize to the prize Winner, the Promoter may, in their discretion, cancel the Competition and recommence it at another time under the same conditions or select another Winner.
- The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
- Each response submitted as part of an Entry becomes the property of the Promoter and Aware Super Pty Ltd (Aware). As a condition of entry, each entrant irrevocably grants to the Promoter and Aware a non-exclusive perpetual worldwide licence to use and exploit all intellectual property rights (including, without limitation, copyright) in and to the Entry and consents to the Promoter and Aware doing (or omitting to do) any acts in respect of the Entry which may otherwise constitute an infringement of an entrant’s moral rights. For the avoidance of doubt, the Promoter and Aware may use all or part of an entrant’s Entry for promotional, marketing or publicity purposes, whether in respect of the competition, the Promoter, Aware or otherwise. Each entrant warrants to the Promoter and Aware that the Entry submitted is an original work of the entrant which does not infringe any rights of any third party. A breach of the warranty set out in this condition will result in the entrant’s Entry being invalid. In addition, each entrant indemnifies the Promoter and Aware against all loss, damages and costs incurred by the Promoter and Aware arising from that entrant’s breach of the warranty set out in this condition.
- To the full extent permitted by the law, the Promoter will not be liable for any death, injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize.
